Your Rights

You have the right to:

  • See or get a copy of your record. You can request an electronic or paper copy of your health information. We will respond within 30 days and may charge a reasonable, cost-based fee.

  • Request a correction. If you believe information in your record is incorrect or incomplete, you can ask us to correct it. We may say no, but we will tell you why in writing within 60 days.

  • Request confidential communication. You can ask us to contact you in a specific way or at a specific location, and we will honor reasonable requests.

  • Ask us to limit what we share. You can ask us not to use or share certain information. We are not required to agree, but if you pay out-of-pocket in full for a service, we will honor a request not to share that information with your insurer.

  • Get a list of disclosures. You can request an accounting of disclosures we have made in the past six years, with certain exceptions. We provide one free accounting per year.

  • Get a copy of this notice at any time, in paper form, upon request.

  • Designate a personal representative. Someone with legal authority to act on your behalf — such as a holder of your medical power of attorney or a legal guardian — may exercise these rights for you.

  • File a complaint. If you believe your privacy rights have been violated, you may contact us or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights at hhs.gov/hipaa/filing-a-complaint or 1-877-696-6775. We will not retaliate against you for filing a complaint.

How We Use and Share Your Information

We use your health information to provide and coordinate your care, run our practice, and bill for services. We do not sell your information, use it for marketing, or contact you for fundraising.

We may also share your information when required or permitted by law, including:

  • Reporting suspected abuse, neglect, or domestic violence

  • Preventing a serious and imminent threat to health or safety

  • Responding to valid court orders, subpoenas, or law enforcement requests

  • Complying with workers' compensation requirements

  • Cooperating with public health authorities or government oversight agencies

  • Health research, subject to legal safeguards

Psychotherapy notes receive additional protection under the law. Most uses and disclosures of psychotherapy notes require your separate written authorization.

Substance use disorder records, if applicable, are protected under both HIPAA and 42 CFR Part 2. We will not use or share those records in civil, criminal, administrative, or legislative proceedings against you without your written consent or a court order and subpoena.

State Law Protections

State law provides stronger privacy protections for mental health records in many situations, and we follow the more protective standard.

  • Illinois clients: Your records are protected under the Illinois Mental Health and Developmental Disabilities Confidentiality Act (740 ILCS 110), which limits disclosure of mental health records and communications, including in legal proceedings.

  • Missouri clients: Missouri law provides additional confidentiality protections for behavioral health records.

Your Choices

You can tell us your preferences about sharing your information with family members, close friends, or others involved in your care. If you are unable to communicate your preferences — for example, in an emergency — we may use our judgment to share information in your best interest.

Our Responsibilities

We are required by law to maintain the privacy and security of your protected health information, notify you promptly of any breach that may affect your information, and follow the practices described in this notice.

We will not use or share your information in ways not described here without your written permission. You may revoke any permission you have given us at any time, in writing.

Changes to This Notice

We may update this notice at any time. Changes apply to all information we hold about you. The current version is always available on this page and upon request at our office.
